CCPA & CPRA Compliance Notice

1. Introduction and Scope

This California Privacy Rights Notice ("Notice") supplements the information contained in the Result Maxima Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you"). This Notice is provided pursuant to the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and any implementing regulations (collectively, "California Privacy Laws").

Result Maxima, headquartered in Brooklyn, New York, is committed to protecting the privacy and security of California residents' personal information. We adopt this Notice to comply with California Privacy Laws and to inform California residents of their privacy rights and how they can exercise those rights.

Any terms defined in the CCPA and CPRA have the same meaning when used in this Notice. This Notice does not reflect our practices with respect to personal information relating to job applicants, employees, or contractors, or information we process as a "service provider" on behalf of our business clients.

The CPRA, which took full effect on January 1, 2023, significantly expanded the rights of California consumers and the obligations of businesses that collect and process personal information. This Notice reflects the requirements of both the original CCPA and the CPRA amendments, including new rights such as the right to correct, the right to limit sensitive personal information use, and enhanced opt-out rights for cross-context behavioral advertising.

We encourage you to read this Notice carefully to understand your rights under California law. If you have questions about this Notice or our privacy practices, please contact us using the information provided in Section 28 below.

2. Definitions Under California Law

For purposes of this Notice, the following definitions apply:

  • "Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include publicly available information, lawfully obtained truthful information that is a matter of public concern, deidentified or aggregated consumer information, or information excluded from the CCPA's scope.
  • "Sensitive personal information" means personal information that reveals a consumer's social security, driver's license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials; precise geolocation; racial or ethnic origin, religious or philosophical beliefs, or union membership; contents of mail, email, or text messages (unless the business is the intended recipient); genetic data; biometric information; health information; or information concerning sex life or sexual orientation.
  • "Sale" means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for monetary or other valuable consideration. A "sale" does not include sharing of personal information with service providers, sharing at the consumer's direction, or transfers as part of a merger or acquisition.
  • "Share" or "Sharing" means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
  • "Service provider" means a person or entity that processes personal information on behalf of a business and to which the business discloses a consumer's personal information for a business purpose pursuant to a written contract that prohibits the service provider from retaining, using, or disclosing the personal information for any purpose other than for the specific purpose of performing the services specified in the contract.
  • "Third party" means a person or entity who is not the business that collects personal information, a service provider, or a contractor.
  • "Business purpose" means the use of personal information for the business's operational purposes or other notified purposes, provided that the use is reasonably necessary and proportionate to achieve the purpose for which the information was collected or processed.
  • "Commercial purpose" means to advance a person's commercial or economic interests, such as inducing another person to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services.
  • "Cross-context behavioral advertising" means the targeting of advertising to a consumer based on the consumer's personal information obtained from the consumer's activity across businesses, distinctly-branded websites, applications, or services, other than the business, distinctly-branded website, application, or service with which the consumer intentionally interacts.

3. Overview of Your Rights

Under California Privacy Laws, California residents have the following rights with respect to their personal information:

Right to Know

You have the right to request that we disclose information about our collection, use, and disclosure of your personal information over the preceding 12 months.

Right to Delete

You have the right to request deletion of personal information we have collected from you, subject to certain exceptions.

Right to Correct

You have the right to request that we correct inaccurate personal information that we maintain about you.

Right to Opt-Out

You have the right to opt out of the "sale" of your personal information and the "sharing" of your personal information for cross-context behavioral advertising.

Right to Limit Use of Sensitive Information

You have the right to limit our use or disclosure of your sensitive personal information to uses necessary to perform our services or provide goods.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment for exercising any of your privacy rights.

4. Right to Know

You have the right to request that we disclose certain information to you about our collection, use, and disclosure of your personal information over the past 12 months. Once we receive and verify your request, we will disclose to you:

  • The categories of personal information we collected about you
  • The categories of sources from which we collected personal information about you
  • The business or commercial purpose for collecting, selling, or sharing personal information about you
  • The categories of third parties to whom we disclosed personal information about you
  • The categories of personal information sold or shared about you and the categories of third parties to whom the personal information was sold or shared, by category of personal information for each category of third parties
  • The categories of personal information disclosed about you for a business purpose and the categories of persons to whom it was disclosed
  • The specific pieces of personal information we collected about you

You may request disclosure of any or all of the above information. We are not required to provide personal information to you more than twice in a 12-month period. We are not required to retain personal information collected for a single, one-time transaction if it is not sold or retained in the ordinary course of business.

Please note that we cannot disclose to you the specific pieces of personal information we collected about you if disclosure creates a substantial, articulable, and unreasonable risk to the security of the personal information, your account with us (if any), or the security of our systems or networks.

5. Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you
  • Help to ensure security and integrity to the extent the use of the consumer's personal information is reasonably necessary and proportionate for those purposes
  • Debug products to identify and repair errors that impair existing intended functionality
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law
  • Comply with the California Electronic Communications Privacy Act (California Penal Code Section 1546 et seq.)
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us
  • Comply with a legal obligation
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it

When we delete personal information, we will also notify all service providers, contractors, and third parties to whom we have sold or shared the personal information to delete your personal information, unless this proves impossible or involves disproportionate effort.

6. Right to Correct

You have the right to request that we correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.

Once we receive and verify your request, we will use commercially reasonable efforts to correct the inaccurate personal information. We will also instruct our service providers to make the correction in their records.

We may require you to provide documentation supporting your request for correction. In evaluating your request, we will consider the totality of the circumstances, including the nature and source of the information, our ability to verify the accuracy of the information, the type of record in which it is maintained, and any documentation you provide.

If we deny your request for correction in whole or in part, we will explain the basis for our denial. You may then provide us with a written statement explaining your belief that we maintain inaccurate personal information about you. We will maintain your statement as part of your records.

7. Right to Opt-Out of Sale/Sharing

California law gives you the right to opt out of the "sale" of your personal information and the "sharing" of your personal information for cross-context behavioral advertising purposes to third parties. The CPRA defines "share" broadly to include any sharing of personal information for cross-context behavioral advertising, whether or not for monetary consideration.

Our Current Practices: As of the date of this Notice, Result Maxima does NOT:

  • Sell personal information to third parties for monetary consideration
  • Share personal information with third parties for cross-context behavioral advertising
  • Use or disclose sensitive personal information for purposes other than those permitted by law

Because we do not engage in these practices, there is currently no need for you to opt out of sales or sharing. However, if our practices change in the future, we will update this Notice and provide you with appropriate mechanisms to exercise your opt-out rights, including a "Do Not Sell or Share My Personal Information" link on our website.

8. Right to Limit Use of Sensitive Personal Information

California law provides you with the right to limit the use and disclosure of your sensitive personal information. You may request that we limit the use of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.

Our Current Practices: Result Maxima does NOT collect sensitive personal information as defined under the CCPA/CPRA, except where strictly necessary for specific services you request. We do not collect:

  • Social Security numbers, driver's license numbers, or passport numbers
  • Account log-in credentials in combination with required security codes
  • Precise geolocation data
  • Racial or ethnic origin data
  • Religious or philosophical beliefs
  • Union membership information
  • Contents of private communications (unless we are the intended recipient)
  • Genetic or biometric data for identification purposes
  • Health information
  • Information about sex life or sexual orientation

If we begin collecting sensitive personal information for uses beyond what is necessary to perform our services, we will update this Notice and provide you with a "Limit the Use of My Sensitive Personal Information" link to exercise this right.

9. Right to Non-Discrimination

We will not discriminate against you for exercising any of your rights under California Privacy Laws. Unless permitted by law, we will not:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits or imposing penalties
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services
  • Retaliate against you for exercising your rights, including by refusing to provide services, changing the terms of a contract, or taking other adverse actions

However, we may offer you certain financial incentives permitted by California Privacy Laws that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to the value of your personal information and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

10. Categories of Personal Information Collected

11. Sources of Personal Information

We collect personal information from the following categories of sources:

  • Directly from you: Information you provide when you visit our website, submit forms, request services, communicate with us, or otherwise interact with our business. This includes contact information, project requirements, and communications content.
  • Indirectly from you: Information we observe or collect automatically through your use of our website, including through cookies and similar tracking technologies. This includes browsing activity, device information, and general location data.
  • From our service providers: Information we receive from third parties who perform services on our behalf, such as hosting providers, analytics services, and payment processors.
  • Publicly available sources: Information from publicly accessible sources, such as public websites, social media profiles, or government databases, when relevant to our services.
  • Business partners: Information from referral partners, affiliates, or other businesses with whom we have a relationship, when you have engaged with them in connection with our services.

12. Business and Commercial Purposes

We collect, use, and disclose personal information for the following business and commercial purposes:

  • Service delivery: To provide our web design, development, and digital marketing services to clients
  • Communication: To respond to your inquiries, provide customer support, and communicate about our services
  • Transactions: To process payments, complete transactions, and manage client accounts
  • Website operation: To operate, maintain, and improve our website and services
  • Analytics: To understand how our website is used and to improve user experience
  • Marketing: To send you marketing communications about our services (with your consent where required)
  • Security: To detect, prevent, and respond to security incidents, fraud, and illegal activities
  • Legal compliance: To comply with legal obligations, enforce our terms, and protect our rights
  • Research and development: To develop new products and services and improve existing offerings
  • Quality assurance: To ensure the quality of our services and train our team

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

13. Sharing and Disclosure of Personal Information

We may disclose personal information for a business purpose to the following categories of third parties:

  • Service providers: Companies that provide services on our behalf, such as hosting, analytics, payment processing, email delivery, and customer support. These providers are contractually obligated to use personal information only for the purposes for which we disclose it to them.
  • Professional advisors: Lawyers, accountants, auditors, and other professional advisors in connection with the services they provide to us.
  • Business partners: Third parties with whom we partner to offer products or services, when you engage with such offerings.
  • Legal and regulatory authorities: Law enforcement, courts, regulators, and other government authorities when required by law or to protect our legal rights.
  • Parties to business transactions: Potential acquirers, successors, or other parties in connection with a merger, acquisition, reorganization, or sale of assets.

In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose:

  • Category A: Identifiers (to service providers for hosting, analytics, and communication)
  • Category B: Personal information categories under Cal. Civ. Code § 1798.80(e) (to service providers for payment processing)
  • Category D: Commercial information (to service providers for analytics and service delivery)
  • Category F: Internet or network activity (to service providers for analytics and security)
  • Category I: Professional or employment information (to service providers for project management)

14. Sale and Sharing Practices

Result Maxima does NOT sell personal information. We have not sold personal information in the preceding 12 months and do not intend to sell personal information.

Result Maxima does NOT share personal information for cross-context behavioral advertising. We have not shared personal information for cross-context behavioral advertising in the preceding 12 months and do not engage in targeted advertising practices that would constitute "sharing" under the CPRA.

If our practices change in the future, we will update this Notice, provide you with notice of the change, and offer you the opportunity to opt out of the sale or sharing of your personal information.

15. Sensitive Personal Information

We do not collect sensitive personal information as defined under the CCPA/CPRA. We do not collect or process:

  • Social Security numbers, driver's license numbers, state ID card numbers, or passport numbers
  • Account log-in credentials combined with required security or access codes
  • Precise geolocation data
  • Racial or ethnic origin
  • Religious or philosophical beliefs
  • Union membership
  • Contents of mail, email, or text messages (where we are not the intended recipient)
  • Genetic data
  • Biometric information for identification purposes
  • Health information
  • Information concerning sex life or sexual orientation

16. Retention of Personal Information

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. The criteria we use to determine retention periods include:

  • The length of time we have an ongoing relationship with you
  • Whether there is a legal obligation to which we are subject (such as tax or accounting requirements)
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations)
  • The nature and sensitivity of the personal information
  • The purposes for which we collected the information

When we no longer need personal information, we securely delete or anonymize it. If deletion is not immediately possible (for example, because the information has been stored in backup archives), we isolate the information from further processing until deletion is possible.

17. How to Exercise Your Rights

To exercise your rights under California Privacy Laws, you may submit a request by:

18. Verification Process

Upon receiving your request, we will verify your identity to protect against fraudulent requests. We may ask you to provide:

  • Your full name and email address
  • Information about your previous interactions with us
  • Other identifying information we may have on file

We will match the information you provide against information we have in our records. If we cannot verify your identity, we may deny your request.

19. Authorized Agents

You may designate an authorized agent to make a request on your behalf. To do so, you must provide the authorized agent with written permission to submit the request, and we may require verification of your identity directly.

20. Response Timing

We will respond to verifiable consumer requests within 45 days of receipt. If we require more time (up to 90 days total), we will inform you of the reason and extension period in writing.

21. Information About Minors

Our services are not directed to individuals under 16 years of age. We do not knowingly collect personal information from minors. If we learn that we have collected personal information from a minor, we will delete that information promptly.

22. California Shine the Light

Under California Civil Code Section 1798.83 ("Shine the Light"), California residents may request information about personal information disclosed to third parties for direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.

23. Do Not Track Signals

We honor Do Not Track (DNT) browser signals. When we detect a DNT signal, we limit data collection and do not track your online activities across third-party websites.

24. Global Privacy Control

We recognize and honor Global Privacy Control (GPC) signals. When we detect a GPC signal from your browser, we will treat it as a valid opt-out request for the sale or sharing of personal information associated with that browser.

25. Financial Incentives

We do not offer financial incentives or price differences in exchange for the retention or sale of personal information.

26. CCPA Request Metrics

In compliance with CCPA requirements, we compile annual metrics on consumer requests received. These metrics are available upon request by contacting us at hello@resultmaxima.com.

27. Changes to This Notice

We may update this Notice from time to time. The "Last Updated" date at the top of this Notice indicates when it was last revised. Any changes will be effective immediately upon posting.
